OVERVIEW
This website is operated by A & H Wholesales Ltd. under the operating name Thejewellerypak.
Throughout these Terms of Service, “Thejewellerypak”, “we”, “us”, and “our” refer to A & H Wholesales Ltd.
We provide this website, online store, and related information, content, features, tools, products, and services collectively as the “Services”. Our online store uses Shopify's ecommerce platform.
Thejewellerypak operates exclusively online and does not maintain a physical retail store.
These Terms of Service (“Terms”) apply to your access to and use of the Services and to purchases made through our online store.
By accessing the Services or placing an order, you agree to these Terms and to the policies incorporated by reference, including our Return and Refund Policy, Shipping Policy, and Privacy Policy.
Nothing in these Terms limits any right, warranty, condition, remedy, or other protection that cannot lawfully be limited, excluded, or waived under applicable federal, provincial, or territorial law.
We currently accept orders for delivery only to eligible addresses in Canada.
SECTION 1 - ELIGIBILITY AND ONLINE STORE USE
You must be at least the age of majority in your province or territory of residence to place an order.
If you are under the age of majority, you may use the Services only with the involvement and consent of a parent or legal guardian.
You may use the Services and our products only for lawful purposes.
You must not use the Services in a way that violates applicable law, infringes another person's rights, introduces malicious code, interferes with the security or operation of the Services, or attempts to gain unauthorized access to any system or account.
We may refuse or restrict access to the Services for lawful reasons, including suspected fraud, abuse, security threats, misuse of the Services, or a material breach of these Terms.
SECTION 2 - PRODUCTS, DESCRIPTIONS, AND AVAILABILITY
We make reasonable efforts to describe and display our products accurately.
Product photographs, colours, dimensions, weights, packaging, finishes, and other visual details may appear differently because of lighting, screen settings, production batches, and characteristics of natural, handmade, or manufactured materials.
Minor variations that remain within disclosed specifications and do not materially change the product's identity, function, or stated characteristics are not considered defects.
Product descriptions, including descriptions of metals, gemstones, materials, dimensions, finishes, packaging, and care requirements, form part of the information relating to the applicable product.
If a product received materially differs from its description or approved specifications, contact us in accordance with our Return and Refund Policy.
Products are subject to availability.
Placing an item in your cart does not reserve inventory.
We may limit quantities, discontinue products, or restrict sales where reasonably necessary and permitted by law.
SECTION 3 - PRICES, CURRENCY, TAXES, AND CHARGES
Unless clearly stated otherwise, prices are shown in Canadian dollars.
Applicable taxes, shipping charges, discounts, and other charges payable to us will be disclosed before you submit your order.
We may change product prices or promotions at any time. Such changes do not retroactively alter an existing order except where permitted by law, where an obvious error exists, or where you agree to the change.
We will not add an undisclosed mandatory charge after you submit an order.
SECTION 4 - ORDERS, REVIEW, AND CANCELLATION
Submitting an order constitutes a request to purchase the products identified in that order and authorizes us to begin order review and processing.
An automated order acknowledgement confirms that we received the order. It does not prevent us from reviewing the order or, where permitted by law, refusing, limiting, or cancelling it.
We may begin payment review, inventory allocation, verification, sourcing, customization, picking, packing, shipping preparation, or other fulfilment activity shortly after an order is submitted.
We may refuse, limit, or cancel an order for a lawful reason, including:

product unavailability;

an obvious pricing, product, or description error;

payment failure or inability to verify payment;

suspected fraud or unauthorized payment activity;

misuse of promotions or discount codes;

repeated or abusive ordering activity;

delivery or address problems;

failure to satisfy a purchase restriction disclosed before checkout; or
-
another lawful circumstance that prevents or materially interferes with processing or fulfilment.
If we cancel all or part of an order after payment has been collected, the applicable cancelled amount will be refunded to the original payment method.
CUSTOMER CANCELLATION REQUESTS
We do not provide a guaranteed customer cancellation window.
If you wish to request cancellation, contact us at info@jewellerypak.com as soon as possible.
A cancellation request does not itself cancel the order and is not automatically approved or guaranteed.
We may refuse a cancellation request once processing, preparation, sourcing, customization, picking, packing, shipping preparation, or another material fulfilment activity has begun.
Once an order has been fulfilled or transferred to a shipping carrier, it normally cannot be cancelled and, where eligible, must instead be handled under the Return and Refund Policy and Shipping Policy.
For customized, personalized, engraved, branded, private-label, or made-to-order products, cancellation may be refused once customization, production, procurement, printing, engraving, branding, modification, or other customer-specific work has begun.
Wholesale or specially quoted orders may be subject to additional cancellation terms disclosed in the applicable quotation, invoice, product page, order confirmation, or written agreement.
Repeated ordering followed by repeated cancellation requests, fraudulent transactions, abuse of payment processes, improper use of promotions, attempts to reserve inventory without a genuine intention to complete a purchase, or other abusive ordering activity may result in order refusal, additional verification requirements, account restrictions, or restrictions on future orders where reasonably necessary and permitted by law.
Nothing in this section limits any cancellation right specifically provided by applicable law.
SECTION 5 - PAYMENT
You authorize us and our payment service providers to charge the payment method selected by you for the total amount disclosed at checkout.
You represent that you are authorized to use the selected payment method and that the billing information provided is complete and accurate.
Payment processing is provided by third parties and may be subject to their terms and privacy practices.
We are not responsible for a payment provider's independent acts or omissions except to the extent that applicable law makes us responsible.
SECTION 6 - RETAIL, BUSINESS, AND WHOLESALE PURCHASES
The Services may offer products for personal use, business use, or resale.
If you purchase on behalf of a business or other organization, you represent that you have authority to bind that organization to the applicable order terms.
Wholesale, customized, personalized, private-label, branded, made-to-order, or specially quoted orders may be subject to additional written terms disclosed in a quotation, invoice, product page, order confirmation, or separate written agreement.
Those additional terms apply together with these Terms and will control to the extent of a direct inconsistency concerning the particular order.
Consumer protection provisions that apply specifically to consumer transactions may not apply to purchases made primarily for business, commercial, or resale purposes.
Nothing in this section removes any right that applies by law to a particular transaction.
SECTION 7 - SHIPPING, DELIVERY, AND RISK OF LOSS
We currently ship only to eligible addresses within Canada.
Available shipping methods, charges, estimated processing periods, transit estimates, and applicable restrictions are displayed at checkout or described in our Shipping Policy.
We may select an appropriate third-party carrier based on destination, shipment value, product type, package dimensions and weight, service availability, delivery security, estimated delivery performance, and other operational considerations.
We do not guarantee the use of a particular carrier unless a specific carrier and service are expressly confirmed for an order.
You are responsible for providing complete and accurate delivery information and for promptly notifying us if you discover an error.
If a shipment is returned, delayed, redirected, or otherwise affected because of incorrect or incomplete information supplied by you, refusal of delivery, failure to collect the shipment, or a delivery instruction submitted directly by you to the carrier, you may be responsible for reasonable resulting costs to the extent permitted by law.
Delivery dates and transit periods are estimates unless we expressly confirm a guaranteed service or applicable law requires delivery by a particular date.
Carrier operations, severe weather, labour disruptions, emergencies, incorrect delivery information, service interruptions, remote-area conditions, peak-season volume, and other circumstances outside our reasonable control may affect delivery.
We may require a signature, adult signature, identity verification where applicable, hold-for-pickup service, or another delivery confirmation measure for certain orders.
Carrier tracking, signatures, delivery photographs, electronic acknowledgements, access-point records, pickup records, and similar delivery records may be considered as evidence when investigating a delivery dispute.
Such evidence does not automatically override any right available under applicable law.
If you independently authorize a carrier to waive a signature, leave a shipment at a designated location, redirect the shipment, change the delivery address, deliver to another person, or hold the shipment elsewhere, the instruction may affect how the carrier completes delivery and evaluates a resulting claim.
To the extent permitted by applicable law, risk of loss or damage passes to you when the shipment is delivered to the delivery address, authorized alternative location, or carrier pickup location selected or authorized by you.

SECTION 8 - RETURNS, REFUNDS, DAMAGE, AND ORDER ISSUES
Returns, exchanges, refunds, damaged goods, defective goods, incomplete orders, incorrect orders, and other product-related return issues are governed by our Return and Refund Policy.
Shipping loss, transportation damage, missing shipment contents, delivery disputes, and carrier investigations are also subject to the relevant provisions of our Shipping Policy.
We may reasonably require return authorization, supporting evidence, preservation of packaging, inspection, or cooperation with a carrier or insurer as provided in those policies.
A carrier or insurer's decision concerning liability or reimbursement does not, by itself, determine any right or remedy that you have against Thejewellerypak under applicable law.
Do not send an item to a business, mailing, or contact address as a return unless we have authorized the return and provided applicable return instructions.
Unauthorized returns may be refused or returned to the sender to the extent permitted by law.
SECTION 9 - ACCOUNTS AND CUSTOMER INFORMATION
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity conducted through the account.
Notify us promptly if you believe your account has been accessed without authorization.
You agree to provide current, complete, and accurate order, account, billing, payment, and delivery information and to update it where necessary.
We may suspend an account or require additional verification where reasonably necessary to protect you, us, our payment providers, or the Services from fraud, misuse, abuse, or security threats.
SECTION 10 - PROMOTIONS, DISCOUNT CODES, AND GIFT CARDS
Promotions, discount codes, store credits, and gift cards may be subject to additional terms disclosed when offered.
Unless otherwise stated, promotions cannot be combined, have no cash value, and may not be applied retroactively.
We may cancel, correct, limit, or refuse a promotion that contains an obvious error or is used fraudulently, abusively, or contrary to its disclosed terms.
Any expiry date, fee, or other restriction on a gift card or prepaid purchase card applies only where permitted by law.
SECTION 11 - SITE INFORMATION, ERRORS, AND CHANGES
We make reasonable efforts to keep information on the Services accurate and current.
Information may occasionally contain typographical errors, inaccuracies, omissions, or technical errors relating to product descriptions, prices, promotions, availability, shipping charges, or processing and transit estimates.
We may correct errors and update information.
If an error materially affects an order that you already placed, we will provide any notice, correction, cancellation, or other option required by applicable law.
We may modify, suspend, or discontinue non-purchased portions of the Services at any time.
This does not affect obligations relating to existing orders or rights that have already accrued.
SECTION 12 - OPTIONAL TOOLS AND THIRD-PARTY SERVICES
The Services may provide access to tools, applications, payment options, social media features, integrations, or other services supplied by third parties.
Your use of an independent third-party service may be governed by that third party's own terms and privacy policy.
We do not control and are not responsible for an independent third party's service, content, availability, operation, or security except to the extent that applicable law makes us responsible.
SECTION 13 - THIRD-PARTY LINKS
The Services may contain links to websites, services, or resources operated by third parties.
A link does not mean that we operate, control, or necessarily endorse the third party.
You should review the third party's applicable terms, privacy practices, and product or service information before entering into a transaction with that third party.
Complaints concerning products or services purchased directly from an independent third party should be directed to that third party.
This section does not apply where Thejewellerypak is the seller of record or applicable law otherwise makes us responsible.
SECTION 14 - INTELLECTUAL PROPERTY
The Services and their content, including text, photographs, graphics, product presentation, logos, trademarks, layout, and software, are owned by us, licensed to us, or used with permission and are protected by applicable intellectual property laws.
We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Services for lawful personal or internal business purposes.
Except where permitted by law, you may not copy, reproduce, modify, distribute, sell, scrape, republish, or commercially exploit the Services or their content without prior permission from the applicable rights holder.
SECTION 15 - REVIEWS, FEEDBACK, AND USER CONTENT
If you submit a review, photograph, comment, feedback, or other content (“User Content”), you represent that you have the right to submit it and that it is accurate to the best of your knowledge.
User Content must not be unlawful, misleading, defamatory, abusive, obscene, infringing, malicious, fraudulent, or harmful to another person's privacy or rights.
You retain ownership of your User Content.
By submitting User Content to us or through the Services, you grant us a worldwide, non-exclusive, royalty-free licence to host, reproduce, format, translate, publish, display, and distribute that User Content for operating, improving, and promoting our business and Services.
This licence is subject to applicable law and any applicable privacy rights concerning personal information.
We may moderate or remove User Content that violates these Terms or applicable law and are not required to publish or respond to every submission.
SECTION 16 - PRIVACY AND ELECTRONIC COMMUNICATIONS
Our collection, use, disclosure, storage, and processing of personal information are described in our Privacy Policy.
By placing an order, you agree that we may send transactional communications reasonably necessary to process, fulfil, deliver, and support that order.
Marketing or promotional communications will be sent only in accordance with applicable law.
Where an unsubscribe mechanism is provided, you may use it to stop applicable marketing communications.
Unsubscribing from marketing does not prevent transactional, security, legal, account, or customer-service communications.
SECTION 17 - PROHIBITED USES
You must not use the Services or their content:

for an unlawful, fraudulent, deceptive, or abusive purpose;

to infringe intellectual property, privacy, publicity, contractual, or other rights;

to harass, threaten, defame, discriminate against, or harm another person;

to submit false, fraudulent, or misleading information;

to upload or transmit malware, viruses, or destructive code;

to collect or track another person's personal information without lawful authority;

to spam, phish, pharm, pretext, scrape, crawl, or access the Services by automated means contrary to our instructions or applicable law;

to interfere with the security, integrity, or operation of the Services; or

to evade purchase limits, payment controls, security controls, or fraud-prevention measures.
We may suspend or terminate access, refuse orders, require additional verification, or take other reasonable protective measures in response to a violation, subject to applicable law.
SECTION 18 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
Nothing in this section excludes, restricts, or modifies any warranty, condition, right, remedy, or liability that cannot lawfully be excluded, restricted, or modified under applicable law.
We do not guarantee, represent, or warrant that your use of the Services will be uninterrupted, timely, secure, or error-free.
We do not warrant that results obtained from use of the Services will always be accurate or reliable.
To the maximum extent permitted by applicable law, you expressly agree that your use of, or inability to use, the Services is at your sole risk.
Except as expressly stated by us or required by applicable law, the Services and all products and services delivered to you through the Services are provided “as is” and “as available”, without representations, warranties, or conditions of any kind, either express or implied, including implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
To the maximum extent permitted by applicable law, in no case shall A & H Wholesales Ltd., operating as Thejewellerypak, or our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including lost profits, lost revenue, lost savings, loss of data, replacement costs, or similar damages, whether based in contract, tort, including negligence, strict liability, or otherwise, arising from your use of or inability to use the Services, any product obtained through the Services, or any other claim relating to the Services or a product, including errors or omissions in content or loss or damage arising from content or products made available through the Services, even if advised of their possibility.
Where a province, territory, or other jurisdiction does not permit a particular exclusion or limitation of warranties or liability, the applicable exclusion or limitation will apply only to the maximum extent permitted by law.
SECTION 19 - INDEMNIFICATION
To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless A & H Wholesales Ltd., operating as Thejewellerypak, and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees from any third-party claim or demand, including reasonable legal fees, arising from your breach of these Terms or the policies incorporated by reference, your unlawful use of the Services, or your violation of applicable law or the rights of a third party.
SECTION 20 - SUSPENSION AND TERMINATION
These Terms remain effective while you use the Services.
You may stop using the Services at any time.
We may suspend or terminate access where you materially breach these Terms, use the Services unlawfully, or create a genuine fraud, abuse, or security risk.
Where reasonable and appropriate, we may provide notice or an opportunity to correct the issue.
Suspension or termination does not affect rights, payment obligations, existing orders, or liabilities that arose before suspension or termination.
Provisions that by their nature should survive termination will continue to apply.
SECTION 21 - GOVERNING LAW AND DISPUTES
These Terms and transactions with us are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-laws rules.
The courts of Ontario will have jurisdiction over disputes except where mandatory law applicable to a particular transaction gives a party the right to bring a claim in another forum or provides another non-waivable protection.
Nothing in these Terms prevents either party from using an available small claims court process or first attempting to resolve a complaint directly.
Before starting formal proceedings, you are encouraged to contact us so that we may attempt to resolve the matter.
This request does not shorten or suspend any legal limitation period unless applicable law or a written agreement provides otherwise.
SECTION 22 - ENTIRE AGREEMENT, SEVERABILITY, AND NO WAIVER
These Terms, the policies incorporated by reference, and any applicable order-specific terms form the agreement concerning use of the Services and the applicable transaction.
A product page, quotation, invoice, order confirmation, or separate written agreement may contain additional terms for a particular purchase.
If a provision of these Terms is found unlawful, void, or unenforceable, it will be enforced to the maximum lawful extent or severed to the extent necessary, and the remaining provisions will continue in effect.
Our failure to enforce a provision on one occasion does not waive that provision or our right to enforce it later.
SECTION 23 - CHANGES TO THESE TERMS
We may update these Terms by posting a revised version and changing the “Last updated” date.
Changes apply prospectively from their effective date.
Changes do not retroactively alter the terms applicable to an existing order unless required by law or agreed by the parties.
Your continued use of the Services after revised Terms take effect constitutes acceptance of the revised Terms for future use of the Services, subject to applicable law.
